By submitting this purchase form and/or operating our product, purchaser acknowledges the inherent risks associated with moving trailers not connected to a vehicle, and agrees that purchaser is solely responsible for all risks and liabilities associated with the assembly, modification and/or operation of the power dolly. The purchaser understands their new power dolly is not a toy, but a very powerful piece of equipment designed to move very heavy trailers. Knowing this, the purchaser agrees to never operate their power dolly while under the influence of alcohol, narcotics, and/or prescription drugs.
The purchaser agrees to never allow any other person to operate the power dolly while under the influence of alcohol, narcotics, and/or prescription drugs, and to never let anyone under the age of 16 years operate the machine.
The purchaser agrees to never operate their power dolly during adverse weather conditions including but not limited to surfaces covered by snow and/or ice. The purchaser understands that there are weight and operation limitations specific to the model of trailer dolly they are operating, which can be found at www.traxpowerdolly.com and will never operate the machine outside of those limitations.
In the unlikely event of a dispute hereunder, purchaser agrees that all such claims must be filed and resolved exclusively in the Elgin County Courthouse, St. Thomas, Ontario, Canada. In no event shall Trax Power Dolly Systems Inc. be liable for any special, indirect or consequential damages or any damages whatsoever resulting from the assembly, modification, and/or operation of this power dolly, and purchaser-on behalf of himself/herself and any sucessors or assigns-expressly releases Trax Power Dolly Systems Inc. from any and all liabilities, claims and causes of action arising there from.
